This 1-day Legal Issues in Purchasing and Supply workshop covers an array of legal issues facing today's buyers. The differences between buying products and services and Uniform Commercial Code will be highlighted. The principles of agency, contracts, warranties, performance, remedies, termination, and offer and acceptance will be examined. We will also discuss the role of purchasing in contract writing, drafting terms and conditions, contract interpretation and current legal issue in purchasing.  Participants in the Legal issues in Purchasing Workshop will:

  • Expand your knowledge of legal responsibilities, rights, issues and liabilities
  • Raise your understanding of the key aspects of the Uniform Commercial Code, as well as other laws and regulations governing purchases
  • Become skilled in evaluating contract and purchase order's terms and conditions to identify critical elements to ensure validity, completeness, and legal adequacy
  • Learn how to protect the interests of your company or organization should a supplier encounters performance and/or financial difficulties
  • Understand how to assess supplier's proposals and counter-proposals

The Contract Management Process workshop provides participants with an understanding of the concepts, tools, and processes used to create, document, administer, terminate/renew, and manage an organization's Purchasing & Supply Chain contracts. This workshop will provide you and your organization: 

These workshops are designed to "raise the bar" on the levels of Quality Assurance, Service, Cost Control, and Risk Management for the Goods & Services your organization buys.  You will learn how to achieve this by establishing an efficient, cost effective contracting process that avoids potential business/legal risks while integrating your strategies into your contracts.  These workshops are designed to efficiently deliver your business requirements while avoiding the pitfalls of costly and time consuming litigation.   Participants in the Contract management Process Workshop will:

  • Develop an understanding of basic contracting concepts, tools, and processes (common types of contracts, cost/pricing contract variations) 
  • Understand how to use a 6 - Step Contract Process that covers the "end-to-end" steps to integrate your strategies into your contracts while minimizing your business risks. 
  • Develop key insights and best practices relative to the contract preparation & creation process including a review of common contract clauses.
  • Learn the essential considerations for documenting and administering contracts.
  • Effectively manage contract terminations or renewals. 
  • Understand the strategic implications of managing the overall contracting process (i.e. tracking,  reporting, & strategic leverage à Spend Analysis)
